가이언(Guardian) 제도는 한국분에게 다소 생소한 제도입니다. 일반적으로 후견인이라 하는데 단순한 후견인이 아닌 부모와 떨어져 생활해야 하는 18세 미만의 학생에게 부모를 대신해 현지에서 우리 아이처럼 보살필 수 있는 사람이어야 하며, 낮선 환경 속에서 공부해야 하는 학생들에게 법적, 정신적 도움을 줄 수 있는 사람을 뜻합니다. 가디언의 중요성은 유학생활의 현지 적응을 돕기위한 필수적입니다. 위급한 상황뿐 아니라 평상시에도 유학생의 캐나다 현지 부모의 역활을 할 수 있는 사람이어야 합니다. 학교 선정만큼 중요한 것이 올바른 인격을 갖추고 현지사정에 밝은 가디언을 선정하는 일이라 하겠습니다. 가디언의 선정조건 및 운영방식은 교육청마다 내용이 각기 다르므로 입학 전 해당 사항을 교육청에 문의하여야 합니다. 18세 미만의 국제학생(유학생)이 부모와 함께 거주하지 않는 경우 가디언지정을 의무사항으로 규정하고 있습니다.

미성년자를 구분하는 연령은 주마다 차이가 있습니다.

18세: Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, Saskatchewan
19세: British Columbia, New Brunswick, Newfoundland, Nova Scotia, Northwest Territories, Nunavut, Yukon

기숙사 학교에 입학할 예정인 미성년자 학생도 여기에 포함됩니다.

후견인은 미성년자 자녀가 캐나다에서 유학하는 동안, 그 중에서도 특히 긴급 상황이 발생할 경우, 부모를 대신하여 해당 자녀를 일상적으로 보호하고 돌볼 목적으로 부모에 의해 지정됩니다. 후견인은 학교나 출입국 절차와 관련된 문제가 생길 경우 가장 먼저 연락을 받는 보호자로서의 역할도 담당합니다. 그러므로 부모는 자녀의 후견인을 주의 깊게 선택해야 합니다. 부모는 후견인이 자녀와 충분히 가까운 거리에 거주하고 있는지도 확인해야 합니다.

부모는공증을 받은 후견인지정서를 제출해야합니다.
후견인지정서에는 부와모가 함께 서명해야하며, 부와모 각자의서명에대해 공히 공증을 받아야 합니다.
본 서류는 후견인이 미성년자 자녀와 충분히 가까운 거리에 거주하고있으며 긴급상황이 발생할 경우 후견인이 자녀에게 도움을 제공 할 능력을 갖고있다는 사실에 부모가 만족하고있음을 반드시 명시해야합니다.

후견인은 공증을 받은 후 견인수락서를 제출해야 합니다.
후견인수락서는 후견인 본인이 만 19세 이상의 캐나다 시민권자 혹은 영주권자로서 해당 학생과 충분히 가까운거리에 거주하고 있음을 반드시 명시해야 합니다.
후견인수락서는 캐나다 현지 공증사무소에서 공증을 받아야합니다.

2. 부모가 이혼한 경우에는, 친권을가진 부/모가 후견인지정서를 제출하시면 됩니다.
친권이 없는 부/모로 부터는 제출하실 서류가 없습니다.

3. 결혼관계에 있는 부모 중 한 명이 학생과 동반하는 경우라 할지라도, 동반하지않는 다른 부/모로 부터의 사실공증된 부모 동의서를 제출하셔야 합니다. 동의서에는 임시거주방문비자(B항 참조)를 신청하는 부/모가 그 자녀를 동반하여 캐나다에 체류할 것을 허락한다는 내용을 명시해야 합니다.

B. 만 18세미만 신청자 동반 부모의 임시거주방문비자 (TRV) 신청구비서류

여권 또는 여행증명서 원본 및 사본 :
여권의 원본과 최초 두 페이지 및 기한의 연장에 관한 기록이 있는 페이지의 사본을 함께 제출해야 합니다.
동반 가족도 각각의 여권 또는 여행 증명서의 원본과 사본이 별도로 필요합니다.

부/모의TRV신청서에 미취학 동반자녀가 포함된 경우 :

동의서에는 TRV를 신청하는 부/모가 그 자녀를 동반하여 캐나다에 체류할 것을 허락한다는 내용을 명시해야 합니다.

A.CUSTODIANSHIP AND PARENTAL CONSENT FOR APPLICANTS UNDER THE AGE OF MAJORITY
1. All intending students below the age of majority (minor students) must provide notarized declarations of custodianship granted by their parents and accepted by a custodian in Canada.

The age of majority varies from province to province:

Age of majority is 18 in:
Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, Saskatchewan
Age of majority is 19 in:
British Columbia, New Brunswick, Newfoundland, Nova Scotia, Northwest Territories, Nunavut, Yukon
This includes minor students destined to a RESIDENTIAL or BOARDING school.

Custodians are designated by parents to act on their behalf to provide daily care and support to their minor child, particularly in case of an emergency, while that child is a student in Canada. Often, the custodian will also be the primary contact person for the school and for immigration-related matters. Parents should, therefore, select their child's custodian carefully. Parents should also ensure that the custodian resides within a reasonable distance of the student.

PARENTS provide: A NOTARIZED CUSTODIAN APPOINTMENT LETTER - must be signed by both parents and the notarization should be for both signatures. The letter must state that the parent is satisfied that the custodian resides within a reasonable distance of the minor student and will be able to provide assistance to the student in the event of an emergency. CUSTODIAN provides: A NOTARIZED CUSTODIAN AGREEMENT LETTER - must indicate that the custodian is a Canadian citizen or permanent resident of Canada, over 19 years of age, and resides within a reasonable distance of the student. The custodian agreement letter should be notarized in Canada by a Canadian notary public. -Any typos or errors in name, birthday, etc, found in the above two notarized documents may result in the refusal of the application.

2. If parents are divorced, a notarized custodian appointment letter is required from the parent with custody. A notarized consent letter is no longer required from non-custodial parents.

3. If a student will be accompanied by one parent, the notarized parental consent of the other parent is still required (even if the parents are married). The consent letter should state clearly that permission is granted to the other parent to take the minor child to Canada.

B. DOCUMENTS REQUIRED FOR ACCOMPANYING PARENT'S TEMPORARY RESIDENT PERMIT (TRV) APPLICATION

Original passport or travel certificate and photocopies of the first two pages of your passport or travel certificate and any pages which note passport extensions: include passports of all dependants who will accompany you to Canada. NOTE : Your passport should be valid for at least 6 months. It is recommended to have passports valid for the duration of your intended stay in Canada as passport expiry will restrict TRV validity.

Completed and signed application form for TRV: complete in English or French. You should fill out the information on your spouse and children and indicate whether or not they will accompany you to Canada.

In case a minor child is included in the TRV application of a parent, we require Identification Certificate of the minor child and a notarized parental consent of the other parent. The consent letter should state clearly that permission is granted to the other parent to take the minor child to Canada.
